This document is a legally binding browse-wrap agreement between you (hereinafter referred to as ‘user’, ‘you’, or ‘your’) and Flipped Classroom Education Pvt Ltd, a company incorporated under the provisions of the Companies Act, 2013 operating under the trade name Flipped Classroom (hereinafter referred to as ‘the company’, ‘Flipped Classroom’, ‘us’, ‘our’, or ‘we’).

These terms and conditions shall apply to your use of our Website (www.Flipped Classroom.co.in) or any derivative webpages thereof (hereinafter referred to as ‘site’ or ‘website’), availing of our Programs and Services, Online Communities, Open or Closed Groups or Social Platforms including but not limited to LinkedIn, Meta, Instagram, Twitter etc. and any other platforms that may be made available to you in the future including, but not limited to, Mobile Applications and Electronic Devices in connection with our Services.

By enrolling for any of our programs, subscribing to any services and/or accessing this website in any manner, you consent to be bound by all of the terms and conditions contained herein. These terms and conditions along with our Privacy Policy and other policies implemented and published on the Platform from time to time or any amendments thereof (collectively referred to as the “Terms”) govern Flipped Classroom’s relationship with you.

Definition Clause

For the purposes of this agreement, the following terms shall have the meaning as ascribed to them below:

‘Learner’ means any person who has enrolled in any of our programs or availed of any of our services after paying the program fee. It includes anyone who shows a willingness to enroll in any of our programs or other services by paying the necessary token amount.

‘Platform’ means and includes our website or any derivative webpages, online communities, open and closed social groups, social platforms such as LinkedIn, Meta, Instagram, Twitter, etc. and any other mode of communication that may be made available to you in the future in connection with our services.

‘Program Fee’ is the total amount to be paid in advance for enrolling in any of our programs or availing of any other services.

‘Service’ means service of any description that is made available on our platform to potential users and includes, but is not limited to, our certification programs, demo sessions, consultation sessions, workshops, webinars, in-person sessions or any similar service but does not include the rendering of any service free of charge.

‘Token Amount’ is a part of the program fee that is paid in advance to complete a booking and reserve a slot in any of our programs or other services for a limited period of time.

‘User’ means any person who accesses, views, or uses our platform to obtain information about our services or for any other reason whatsoever.

Access to Our Services

Flipped Classroom enables the dissemination of educational content related to soft skills and power skills development through its various leadership programs, which are available on its website and other platforms. These programs are open for enrolment for a diverse set of audiences and are delivered through different media channels such as audio, visual, textual or physical means (more fully described in our Program Brochure made available on demand). Enrolment and access to these services are subject to the following conditions:

Learners must meet the necessary eligibility criteria as specified by our Program Advisors to be qualified for our services.

Subscription to any service will allow you access only to the content and sessions available under such service. We may, in our sole discretion, decide to add on certain additional and optional content or sessions, free of charge or for a fee, from time to time, but this cannot be claimed as a right by the Learner.

Unless specifically allowed, the online content may not be available for download or in hard printed copy.

The content of any program or other services is licensed only to the learner who has paid the program fee and enrolled for the program. Such content shall be for personal use only. Any public dissemination or commercial use of program resources will be a violation of our copyright and may lead to immediate termination of your access to our services.

A learner shall be awarded the Certificate of Completion after s/he has enrolled her/himself in any of our programs, has undergone the entire curriculum and sessions within the stipulated time and if there are no dues outstanding in her/his name.

Content Ownership and Copyright

The platforms and the content of Flipped Classroom on such platforms, including but not limited to all text, graphics, user interfaces, visual interfaces, sounds, artwork and computer code, are owned and controlled by Flipped Classroom Education Pvt Ltd and the design, structure, selection, expression and arrangement of such content mentioned hereinabove is protected by copyright and trademark laws. We reserve all rights, title, and ownership to the content produced therein.

Your copying, distributing, displaying, reproducing, recording, downloading, modifying, or in any other way using of the content in any manner not specified in these terms will be a violation of copyright and other intellectual property rights, and Flipped Classroom reserves its rights under applicable laws accordingly.

Payment and Refund Policy

Unless otherwise expressly agreed by the company or any agent on behalf of the company, the Program Fee shall be paid in advance at once at the time of enrolment or availing of our services.

However, in exceptional circumstances and at our sole discretion, we may allow a learner to pay a Token Amount in advance to reserve her/his slot for such program or other services subject to the availability of such slots. In such circumstances, access to our services shall be contingent upon the final payment of the outstanding Program Fee within the stipulated time period as specified by our Program Advisors.

Mode of Payment

To make payment for any Program or to avail of any services offered by Flipped Classroom through the platform, you must have internet access and a current valid accepted payment method as indicated on the platform (“Payment Method”). We do not store any of your credit card information or such other information as restricted by the Reserve Bank of India (RBI) for processing payment and have partnered with payment gateways for the payment towards the services. By using a third-party payment provider, you agree to abide by the terms/policies of such third-party payment provider.

You agree that in case Flipped Classroom Education Pvt Ltd’s third-party payment provider stores any such information, we will not be responsible for such storage, and it will be solely at your discretion to allow the third party to store such information as per its terms/policies. Flipped Classroom Education Pvt Ltd shall in no way be liable for the loss of such information or any loss incurred by you due to the misuse of such information. We shall not be obligated to reimburse you for any such loss or to hold you harmless in any manner. You also agree to pay all applicable fees, if any, for the payments made through the platform.

Kindly take into account that we do not support all payment methods, currencies or locations for payment other than those expressly mentioned in the third-party payment pages at the time of payment. All applicable taxes are calculated based on the billing information you provide to us at the time of enrolment/purchase. Your transactions on the platform may be subject to foreign exchange fees or exchange rates as the case may be.

Installments

In exceptional circumstances and at our sole discretion, Flipped Classroom may allow a learner to pay the Program Fee in instalments. If allowed, the learner shall pay the full Program Fee within the stipulated time and within the maximum allowed installments as discussed with the company. To provide you with hassle-free payment processing, we may create an auto NACH debit process. If the automated NACH transaction fails to debit an installment amount for any reason, Flipped Classroom will be free to revoke all access to our services until all dues are cleared.

Refunds

Notwithstanding anything contained herein, the Program Fee or Token Amount for a program or other services is inherently non-refundable under any circumstances whatsoever.

We do not provide refunds of the Token Amount paid to reserve a slot for a program or service for any change of mind, inability to pay the outstanding Program Fee, or any reason whatsoever.

Moreover, we do not provide refunds of the Program Fee paid for enrolment/purchase of a program or service for the lack of usage, dissatisfaction with the program or for any reason whatsoever.

We reserve the right to change, update or modify this Refund Policy at any time at our sole discretion and any such change, update or modification shall become effective immediately upon the same being published on our website.

General

Flipped Classroom reserves the right to recover any reasonable debt collection costs in connection with the Online Terms.

Flipped Classroom may update or amend the Online Terms from time to time to comply with law or to meet its changing business requirements or to correct any errors without notice to you. Any updates or amendments will be posted on the Website or would be notified through Circulars.

You may not assign or sub-contract any of your rights or obligations under the Online Terms to any third party unless agreed to by Flipped Classroom pursuant to Additional Online Terms and Conditions.

Flipped Classroom may assign, transfer or sub-contract any of its rights or obligations under the Online Terms to any third party at its discretion.

You must not engage any faculty or tutor to serve you independently or contact any Faculty privately and disrupt the trade practice by paying them a separate fee and take special assistance.

Any notices required to be served on you by Flipped Classroom under the Online Terms will be deemed properly served if emailed or posted to the email address or address notified by you to Flipped Classroom respectively. Any notices required to be served on Flipped Classroom by you will be deemed properly served if sent by email or post to the address.

A notice sent by post is deemed to be given on the day it was posted as evidenced by the sender. A notice sent by email is deemed to be given on the day it was sent.

The Contract between you and Flipped Classroom will be concluded in English only.

Grievance Redressal Mechanism

In the event you have any queries/complaints regarding usage of our platforms, including but not limited to reporting any violation of these terms, please contact us at customer.support@Flippedclassroom.in for Customers

The complaints will be redressed in the manner provided under the Information Technology Act, 2000 and rules framed thereunder.

These Terms and Conditions constitute an ‘electronic record’ within the meaning of the Information Technology Act, 2000, and the Information Technology (Intermediaries guidelines) Rules, 2011, and do not require physical or digital signatures.
